Agreement
Fableism, LLC (hereafter Fableism) is a company registered in California. Registered at P.O. Box 1658 Atascadero, CA 93423. By your use of the Fableism website and/or by placing an order with Fableism you will be deemed to have read, understood and agreed to these terms and conditions.
Placing an order with Fableism
In order to place a trade order with us, you will need to be previously authorized to do so. Once we have confirmed your eligibility as a retailer of our products you can place an order online. Any preliminary enquiries before ordering can be emailed to us at hello @ fableism.com. We may ask you to prove the existence of your business and the sales methods that you use in order for us to establish that you are a retailer, designer or maker. This may include, amongst other things, providing to us the address of your retail outlet and/or a digital photograph of your storefront and product displays and/or details of the URL of your website.
When you place an order you are making an offer to Fableism to purchase the goods detailed in the order subject to these terms. It is your responsibility to ensure that the details on the order (print name and sku code letter, delivery address details and billing details) are correct for you. When you have placed an order online we will send you an automatic email confirmation to confirm that your order has been received. This email is not a confirmation that your offer to purchase the goods has been accepted and it is not a confirmation that we will be able to meet your order.
Once an order has been shipped, you will receive an email from us notifying you of the dispatch of your order. All orders are shipped using a fully traceable carrier.
Every effort will be made to send out complete orders. If we are not able to deliver the whole of the order at one time due to operational reasons or shortage of stock, we will offer to deliver the order in installments but this may incur extra delivery costs.
It is not possible to add or subtract products, or amend your order in any other way, after you have placed your order with us. If you wish to order extra fabric or products, you will need to place a new order.
Minimum Order Quantities
First order minimum of $500, $300 order minimum thereafter. Annual Minimum of $1000.
Payment
Payment can be made by credit card, debit card or ACH bank transfer at the time of the order.
Customers using ACH transfer as the payment method must let us know prior to payment and include our order number or invoice number within the payment reference section of the bank payment. Failure to do so may delay order shipping.
All bank charges relating to ACH payments must be paid by the customer.
All new accounts are opened on a proforma basis. Full payment must have cleared into the Fableism bank account before any goods will be dispatched.
At the point when your goods are ready to dispatch, a full final invoice will be emailed to you along with tracking information.
Goods must be paid for in full before they are dispatched.
Deposits
Fableism reserves the right to request payment of 65% of the order value before confirming the order. Such a request may be made if one or more of the following conditions apply:
We consider that the order is of an exceptionally high value.
The fabric print and color way are not a product that Fableism would normally retail.
Other circumstances at our discretion.
Deposits are non-refundable unless the fabric print or colorway you want to order is unavailable.
Description
Fableism fabrics are yarn-dyed and woven, therefore there may be some variations in color, texture or finish. These are not considered flaws.
We take extra care to ensure that the specifications and descriptions of Fableism fabrics are accurate but they are not intended to be binding and are intended only to give a general description of the products.
The color accuracy of the colorway options displayed on our website and on our printed material will vary dependent on a number of factors and as such should be seen only as representative. We endeavor to ensure that colors are reproduced as accurately as possible though we cannot control differences that may occur through printing in the catalogue and technical issues online such as different browsers and monitors.
Price
While we try to maintain our prices, they are subject to change from time to time and we will endeavor to inform you of any changes. The price payable by you will be that shown on our final invoice.
All prices on our website are shown in USD, and exclude any import taxes or duties.
Order Cancellation
If you have ordered our fabrics, you may cancel your order with Fableism any time up to the date the order is dispatched.
If your order includes specially-made custom products which have been made to order for you, you may not cancel your order.
As wholesale fabrics are ordered specifically for customers, you may not cancel your order once you have paid either a deposit (if required) or the full invoiced amount.
If you have not paid your full invoice within two weeks of the final VAT invoice date, we reserve the right to cancel your order and return the goods to our supplier. In such circumstances, any deposit paid by you will be non-refundable.
To cancel an order or part of it, please email us at hello @ fableism.com. You may wish to keep a copy of your cancellation notification for your own records.
If we agree to cancel your order or part of it, you will receive a full refund of the price you paid for that part of your order. We will process the refund due to you as soon as is reasonably practicable and, in any case, within 30 calendar days of the day on which you gave us notice of cancellation.
Risk and Title
Risk and responsibility for the Products shall pass to you from the point at which we or the courier first attempt delivery, whether or not you (or any nominated alternative) take delivery or not.
Title to the Products shall not pass to you until we have received payment in full for:
All the Products in respect of the delivery; and
Any applicable delivery or other charges.
Until title to the Products has passed to you, you shall:
Maintain the Products in satisfactory condition and keep them insured against all risks for their full price from the date of delivery (or attempted delivery); and
Give us such information relating to the Products as we may require from time to time, but you may resell or use the Products in the ordinary course of business.
Returns and Claims
You must inspect the goods upon completion of delivery. Items which are damaged, faulty, missing or otherwise materially different from the specification must be reported in writing to Fableism with photographic evidence within thirty (30) working days of receipt of delivery, and before the goods are used, cut, or otherwise altered. Please email hello @ fableism.com with full details of any claim. Claims reported more than 30 days after receipt of delivery will not be accepted.
Depending on the nature of your return or claim, we will review your claim within thirty (30) business days, and we will agree in writing if we authorize the damaged/faulty goods to be returned, replaced or credited. If a return is agreed, you must return the goods in their original condition, within ten (10) working days of receiving your authorization, to the following address:

Returns cannot be made for any other reason other than those listed prior. Returns without prior agreement in writing may be refused and if accepted will be subject to a 30% restocking fee.
Returned goods remain the responsibility of the customer until received by Fableism.
If you have returned the products to us because they are faulty or damaged, we will either offer you a replacement product or credit the price of the defective product (if the returned goods pass inspection).
Refunds will be made in the manner in which payment was received.
Exclusivity
We do not offer exclusivity on any of our standard products.
We do not offer exclusivity to any business selling our products in any specific area / location.

All content and products included on our website and printed material including but not limited to website design, text, graphics, audio clips, visual clips, logos, button icons and the selection and arrangement thereof are the property of Fableism or its content suppliers and are protected by the United States and international copyright laws.
All Fableism products are the property of Fableism and are protected by United States and international copyright laws.
All software used on our website is either the property of Fableism or its software suppliers and is protected by the United States and international copyright laws.
We can supply you with our product and brand images for marketing purposes only.
ALL RIGHTS ARE RESERVED. Permission is granted to electronically copy and to print in hard copy portions of our website for the purposes of placing an order with Fableism and using it as a shopping resource only. Any other use of materials on our website including reproduction for purposes other than those noted above, modification, distribution, transmission, broadcasting republication, downloading or uploading without the prior written permission of Fableism is strictly prohibited.

Fableism has taken all reasonable care in the preparation of the contents of our website and printed material but makes no representation or warranty of any kind with respect to the operation of the website or the information, content, materials, or products included on it.
To the extent permitted by applicable law, Fableism Supply Co makes no warranty, express or implied, as to the accuracy, completeness or currency of the information contained in any of the materials on our website or printed material.
Fableism reserves the right to change price and availability information without notice.

While Fableism takes all reasonable endeavors to ensure a fast and reliable service, it does not guarantee that your use of our website will be error or interruption free and will not be responsible for any loss of, disruption or corruption of any material in transit or data when downloaded onto a computer system.
The entire liability of Fableism under or in connection with any contract for any products to which these conditions apply shall not exceed the price of the products, except as expressly provided in these terms and conditions.
Governing Law and Jurisdiction
Our business and website is controlled and operated by Fableism from its offices in California. We make no representation that materials on our website are appropriate or available for use in other locations and accessing them from territories where their contents are illegal is prohibited. Customers who access our website from locations outside the United States do so at their own risk and on their own initiative and are responsible for compliance with local laws, to the extent that any local laws are applicable.
All terms and conditions shall be governed by and construed in accordance with US law. By using our website and/or placing an order with Fableism, you hereby submit to the exclusive jurisdiction of the courts of the United States for the resolution of any dispute arising under or in connection with these Terms or your use of our website.
General
These conditions shall take precedence over any conditions which may appear in the Customer’s Purchase order, and we shall not be bound by the Customer’s terms and conditions unless expressly agreed by us in writing. These conditions supersede all conditions previously stated.
